How CDMaster32 uses your Internet connection

CDMaster32 is NOT "SPYWare". This documentation will tell the user exactly what CDMaster32 is doing with their Internet connection.

In short, CDMaster32 does not use the user's Internet connection unless specifically told to perform an action that requires an Internet connection. These situations are explained in detail below.

Up Front, Full, Plain Language, Disclosure
1. The registered version of CDMaster32 does not contain Banner ads. Therefore only bullets 2 and 3 are not applicable to the registered version of CDMaster.
2. CDMaster32 does not provide tracking or user demographics.
3. CDMaster32 employs a passive Advertising (AD) system that is completely self-contained inside CDMaster32. By "passive ad system" I mean all the ads you see are built-in to CDMaster32 at compile time (when the application was created from source code). There are no mechanisms inside CDMaster32 that allows the ads to be updated from the Internet. 
4. If the user "click" on an ad they find interesting, CDMaster32 sends the WWW site to your default WWW browser. At that point, the WWW browser is responsible for connecting to and maintaining the Internet connection to the WWW site. CDMaster simply launches the WWW browser. After the URL is sent to the browser, CDMaster no longer communicates with the WWW browser.
5. The Internet CD database (CDDB) will directly connect to the Internet when the user presses one of two buttons on the CDDB screen:
o CDDB Site button will directly contact the http://cddb.cddb.com/~cddb/cddb.cgi application and send the following string to that WWW site: 
cmd=sites&hello=<Email>+cdmaster+2.0alpha&proto=4 
where <Email> is the e-mail address specified by the user (or nobody@zittware.com as default). The purpose of this string is to receive the valid CDDB servers. 
o CDDB Search button will directly connect to the specified server in CDDB site edit box, sending the users e-mail address and the CD data needed to download the CD information from the CDDB servers.
o Users concerned about privacy with CDDB should contact the CDDB server owners at http://www.cddb.com. Once the data leaves CDMaster32, Zittware cannot be responsible for how that data is used.
o If the user enables (checks) the "Keep me notified of future versions of this program" check box, CDMaster32 will send the email address provided in the email address box to Zittware's E-mail opt-in list. As with all internet connects, the Zittware server receives the computer's IP address and the following information from CDMaster32:
email=<Email>&product=cdmaster&justemail=1
No other information is sent to the Zittware server. This option is disabled by default. The user has to specifically enable this feature.
o In the shareware version of CDMaster32, a check for a updated version of CDMaster32 is automatically performed during the CDDB download. This option can be disabled in the registered version of CDMaster32. For more information bullet 8 below.
6. Any URLs the user clicks in the application will cause a WWW browser to be opened with the URL. The method of opening the browser is identical to bullet 4 above.
7. Clicking on some of the "download" buttons inside CDMaster32 will launch a WWW browser with the WWW site information. The method of opening the browser is identical to bullet 4 above.
8. When performing a manual Help/"Check for Newer version" menu option. CDMaster32 contacts Zittware's servers to determine the latest version of cdmaster32 available. As with all Internet connects, the Zittware server receives the computer's IP address and the following information from CDMaster32:

No other information is sent to the Zittware server. CDMaster32 waits for the server to return the latest version number. This server does not track or store version query information. We do not store user's IP addresses.
9. CDMaster32 does not open/maintain/watch for Internet connections. It does not employ any "servers"; therefore, cannot provide a means for someone to hack into the users computer using CDMaster32 as a back door. 

No Unnecessary Information Gathering

* CDMaster32 does not gather any information except where stated disclosure above. 

No Insecure Capabilities

* CDMaster32 does not open/maintain/watch for Internet connections. It does not employ any "servers"; therefore, cannot provide a means for someone to hack into the users computer using CDMaster32 as a back door.


Formal Online Privacy Statement

* In short, the author/owner of Zittware HATES spam. We will never gather your e-mail address from CDMaster32. We will never send you e-mail unless you register with us. 
* We will never sell/transfer/offer your e-mail address outside Zittware. 
* A more formal, up to date Privacy Statement is maintained at our WWW site: http://www.zittware.com.


Preemptive Request for Consent

* If you do not feel comfortable about the information above, do not install this application. 
* Canceling the installation now will prevent CDMaster32 from being installed. The installation program will clean up all the pre-installation files from your computer. 


Removable with Windows Add/Remove Programs

* CDMaster32 employs full compatibility with Windows' Add/Remove program applet. If you choose to uninstall CDMaster32 later, CDMaster32 will not leave residue on your computer. 
* The passive AD system is completely contained within the CDMaster32.EXE. Deleting/Uninstalling CDMaster32 will delete the ad system.

John D. Zitterkopf ("Licensor") is the exclusive owner of the provided software ("Software") and documentation ("Documentation"). The Licensor permits and you ("Licensee") accept  a nontransferable, non-exclusive license to use the Software and Documentation providing the following terms and

The  Licensee is  licensed to have or use a single copy, other than distribution or backup media, of the Software in memory, whether permanent or temporary, on a single machine. Consequently, the Licensee must obtain a license for each machine that the Licensee wishes to use the Software.

5. Disclaimer or other warranties
With the exception of the limited warranty in paragraph 4, there are no warranties, either express or implied, for the Software or Documentation. The Licensor does not warrant that the functions contained in the Software will meet the  Licensee's requirements or that the operation of the software will be error free or uninterrupted. The Licensor expressly disclaims any warrantee as to performance of or results obtained by the Licensee. The Licensee also bares the sole responsibility as to the performance and quality 
of the Software, and assumes the responsibility for selection of the Software to achieve the Licensee's intended results. 
 
6. Limitations of remedies
Since this shareware version has no warranty, the Licensee has no remedy and the Licensor's entire liability is nothing.

In no event shall the Licensor be held liable to the Licensee for any damages, including any lost profits, lost savings, or other damages as a result of the use, misuse, or inability to use the Software even if the 
licensor has been advised of the possibility of such damages.
 
7. General
(a) Transfer
The Licensee may not sublicense, assign, or transfer the Software or License. Any such attempt will void this agreement.
 
(b) Governing Law
This agreement shall be governed by the laws of the United States of America.
 
8. Entire contract
The Licensee acknowledges that the licensee has read, understands, and agrees to be bound by its terms and conditions. The licensee further agrees that this is the complete and exclusive statement to the agreement between the licensor and licensee . The licensee also agrees that this agreement supersedes any proposed or prior agreement, oral or written, and any other communications relating to this subject of this agreement.
